Well i went to detroit this weekend, and me and a few buddies were cruising down a road called Gratiot, alot of fast nice cars go out there every friday and saturday, well we were out there and just cruising and all of a sudden, im getting pulled over. Cop writes me a Drag racing and Impeding traffic ticket. says i was racing the green car next to me. The green car happens to be my friend in his GTP with a body kit modded to hell. Here is how everything happend.

The light turned green, i took off, didnt do over the speedlimit at all, the green car next to me has a cam so it sounds really good at idle, but i paid no mind to the sounds, i had my radio up, and i took off and was in front of him driving the speed limit, cop hit me for drag racing. said i took off to fast, that racing is all about acceleration contests. Im like what the hell just happend, i didnt do a dang thing wrong, i didnt even hit any boost when leaving the intersection, i didnt go over the speedlimit, he says i disrupted traffic, what the heck did i do? Should i fight this? or should i just pay the fine and be done with it? I dont have a job anymore so paying it is going to be hard. What should i do?

Keep in mind i have a history with a street racing ticket where i was acually street racing, so im pretty sure ill get f-ed by the judge. What do i do?

1. why didnt you get a tint ticket when i got one for 40% LOL

2. Do you know how much crap those cops probably put up with in that area ?

3. That is pretty unfair but by the way things probably looked to the cop it could of been legit.

4. but an actual drag racing ticket ? thats BS and not fair.

EDIT: youre going to go against a cop in a this and that happened battle, So You could go there, a cop wouldnt exagerate THAT much from what really happened, so unless the cop was a total jerk. But you could have a good chance at getting the ticket taken off, or one, or a easier fine.

Also the Court House id have to go to is 3 hours from my house.

A kid with a history of street racing tickets riding around in a modded car with other modded cars gets a street racing from a cop. Do you really think that the judge is going to side with you?

You've got a 50-50 chance he wo'nt show ,I would plead not guilty and just explain what happened you have the right to represent yourself if he shows ,first question did he hear the tires squeal 2nd question did you exceed the speed limit?The rest is up to the judge so good luck ,but remember the cop will expect you to plead guilty so he may not show or it may be a scheduled day off so again he may not show.

Tires didnt break loose one bit, and im pretty sure i didnt breach the speed limit, it was a 45 zone, i didnt leave 1st gear.

Def fight it.

Even if you dont win, most judges lower the fines a bit just for showing up.

For the record you don't have to exceed the limit to be considered racing. Personally I think your screwed and you know it. One you went to an area you know is known for such activities. Second your cruising around with a buddy who's car is modded fast and furious style drawing attention. Third you admit to having a history. I say fight it. I'm not sure how that jurisdiction handles courts and police show vs no show. Many of them are not requiring the cop to show up any more for a conviction. They have an officer on court duty to represent the issuing officer. Being the ticket is all the witness that is needed. Hopefully by fighting you come out at worst with an exhibition of speed ticket which I'd believe to be much less then your garden variety street racing.

you can try and fight it but none of my buddys that have gotten those street racing tickets have gotten off.......

so u have 2 options fight it and hope the cop dosent show up
or
plead guilty and ask the judge to reduce it to a impeding traffic violation...... that way u just pay the fine with no points

How can you be both "drag racing" AND "impeding traffic?" Those sound like opposites to me...even my dad, who used to be a cop, said that's just stupid.

Is that exactly what the cop wrote you the tickets for? Because that sounds to me like something you could use as part of an argument. Heck, maybe you could make a deal and plead no contest to the impeding if they drop the drag racing.

Were there any other witnesses, other than your buddy that the cop says you were racing?

If your really serious about getting off hire a lawyer.

Otherwise you'll look like a fool trying to defend yourself and I'm pretty sure the judge will have heard all the stories and why's and what not's and probably has seen the wording on your ticket many times before and the solicitor will have no problems prosecuting you to the fullest.

I'm not sure hiring a lawyer is the best option. When I got arrested for reckless driving, I paid $1000 to a lawyer, and he simply made it so I could plead no contest to a speeding ticket. I could have done that on my own, and saved $1000. What a rip off...

I would recommend talking to a lawyer, though. See what s/he says. But don't commit to anything.

That's your fault you got a bad lawyer.

If you want to beat the charges your best bet is a lawyer. Plain and simple. It may cost you more but if it keeps your record clean it will pay for it in the long run.

was your dad a Michigan cop?..... its basically the way around speeding tickets/street racing tickets around here, cuz most of the judges are cool enough to reduce the penalty....but wont let u off completely

Well here's how I could veiw the two different citations.

Impeding could be he saw the two of you "staging" stopped in both lanes that would be "impeding" then once you got moving it is now "racing". Two different infractions on one citation.

Not saying you did but I bet that is that LEO's standard street racing ticket write-up that the judge/solicitor has seen a hundred times and is well prepared to move forward on both.

The light was red. I dont get how Impeding traffic came into play.

Not all police cars have the cameras, but a lot do.

Not too many in my area.

The cam is on all the time. Usually when the lights are turned on, it automatically saves the past three minutes of footage.

Or at least that's what they do around here.

Sucks but I think you're screwed, only chance is a no-show. As others have said, you don't need to break the speed limit to get a drag racing ticket, it's ridiculous. I should be able to accelerate as fast as I like as long as I'm not spinning my tires.
